By accessing or using www.fixgametech.com (the “Website”), contacting FixGameTech LLC, or requesting, approving, delivering, or receiving any diagnostic, estimate, mail-in service, in-store service, on-site service, or repair (collectively, the “Services”), you (“you”, “Client”, or “Customer”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, do not use the Website or the Services.
FixGameTech LLC (“FixGameTech”, “we”, “us”, or “our”) reserves the right, at our sole discretion, to update, modify, or replace any part of these Terms at any time. Continued use of the Website or Services after changes are posted constitutes acceptance of the revised Terms.
All content on the Website—including, without limitation, text, graphics, images, logos, audio/video clips, downloads, data compilations, and software—is the exclusive property of FixGameTech or its respective licensors and is protected by United States and international laws and treaties. All trademarks not owned by FixGameTech that appear on the Website are the property of their respective owners and may or may not be affiliated with, connected to, or sponsored by FixGameTech.
We are committed to a respectful, safe, and professional environment in all communications and interactions. Abusive language, harassment, threats, profanity, discriminatory remarks, or any inappropriate behavior (in-store, by phone, text, email, chat, social networks, or otherwise) is strictly prohibited. FixGameTech may immediately suspend or terminate communications and Services to anyone engaging in such conduct.
FixGameTech grants you a limited, revocable, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Website. Except as expressly authorized in writing by FixGameTech, you may not download (other than page caching), copy, reproduce, modify, distribute, publicly display, publicly perform, republish, upload, post, transmit, or create derivative works of any material from the Website. Any unauthorized use terminates the permission or license granted by FixGameTech.
If you choose to ship your device to FixGameTech, you are responsible for proper packaging, shipping costs, and insurance. FixGameTech is not responsible for damage or loss in transit prior to our receipt. After repair completion, we can ship devices to the address you provide; shipping and insurance fees apply. We recommend insured and trackable shipping. Additional terms may be set forth in our Mail-In Repairs Policy, which is incorporated by reference if provided to you at the time of service.
Estimated waiting or turnaround times are provided for informational purposes only and do not constitute delivery dates, guarantees, or commitments. Repairs can be delayed by parts availability, supplier backorders, shipping delays, intermittent device behavior, network outages, severe weather, public emergencies, pandemics, staffing constraints, or other events outside our reasonable control.
All estimates or quotes are informational because internal physical or software conditions may not be fully known until the device is opened, tested, or placed under load. The final price may differ from the initial estimate. Your approval of an estimate, signature, payment of a deposit, verbal or written authorization (including text/email authorization), or delivery of the device for service constitutes authorization to proceed and to charge for diagnostics, parts, labor, and any approved services.
(a) Scope. Repairs performed by FixGameTech are covered by a limited, thirty (30) day warranty from the date we notify you that the device is ready for pickup or shipment. The warranty applies only to the specific issue repaired and the parts replaced by FixGameTech. It does not cover unrelated issues, consumables, accessories, software, or data.
(b) Exclusions. The warranty is void if the device has been opened, altered, or serviced by anyone other than FixGameTech; has suffered physical damage, moisture/liquid exposure, electrical surge, misuse, abuse, neglect, or operation contrary to manufacturer instructions; or if the reported issue recurs due to third-party accessories, software/firmware conflicts, or environmental factors beyond our control.
(c) Process. To make a warranty claim, you must return the device to FixGameTech for inspection with your service receipt. We will verify the original repair and, if covered, will re-perform the repair or replace the affected part(s) at our option. Warranty service does not extend or renew the original warranty period.
(d) Manufacturer Warranties. Some repairs may void a manufacturer’s warranty. You acknowledge and accept this risk. FixGameTech is not responsible for manufacturer warranty denials after a repair.
(e) Data and Settings. Warranty does not cover data restoration, software reconfiguration, or loss of settings. We recommend regular backups before and after service.
Customers must inspect their devices at pickup. By leaving our premises with the device (or by accepting shipment delivery) without reporting an issue in that moment, you acknowledge that the Services were completed to your satisfaction except for issues discovered later that are covered under the 30-day warranty terms above.
If a device is received in a powered-off state, or shows signs of previous damage, improper assembly, liquid exposure, impact, or third-party tampering, FixGameTech cannot guarantee successful repair or full functionality. Opening or testing such devices—even with best practices—may result in additional failures inherent to the device’s condition. You accept this risk and agree that FixGameTech is not responsible for such latent or consequential failures.
We will notify you via the contact information you provided (e.g., SMS/email/phone) when your device is ready. It is your responsibility to ensure accurate contact details and to monitor your messages. Devices not collected (or for which return shipping is not arranged) within thirty (30) calendar days after our completion notice will be deemed abandoned. Upon expiration of that period, you irrevocably transfer ownership of the device to FixGameTech without compensation so that we may recover storage space and costs. We may recycle, resell, or otherwise dispose of abandoned property in compliance with applicable law.
When available, you may receive a receipt and/or a ticket number or QR link to check service status in real time. You are responsible for preserving any ticket links or documents we provide. If you supply incorrect contact information (such as a wrong email or phone number), FixGameTech is not responsible for missed notifications or deadlines.
If you create an account on our Website, you are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. We may, at our discretion, refuse service, terminate accounts, remove or edit content, or cancel orders.
Any comments, reviews, messages, ideas, suggestions, or other materials submitted to FixGameTech (“Submissions”) may be used by FixGameTech for any lawful purpose, including improving Services and customer experience, without obligation to compensate you. You represent that you own or control all rights in your Submissions and that they do not infringe third-party rights or contain unlawful content.
The Website may contain links to third-party sites not controlled by FixGameTech. We are not responsible for the content, privacy practices, or security of those sites. Your use of third-party sites is at your own risk. We may disable links at any time in our discretion.
THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FIXGAMETECH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
If you pay by card, you authorize FixGameTech and its payment processors to charge your card for Services, parts, shipping, deposits, and applicable taxes/fees. We use industry-standard security measures (such as TLS/SSL) for transmission of payment information. We do not sell your payment data. Additional payment terms may be presented at checkout or in-store.
You agree to defend, indemnify, and hold harmless FixGameTech, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to (a) your breach of these Terms; (b) your misuse of the Website or Services; (c) your violation of any law or third-party right; or (d) your Submissions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIXGAMETECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES) ARISING FROM OR RELATED TO THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL FIXGAMETECH’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO FIXGAMETECH FOR THE SERVICE GIVING RISE TO THE CLAIM.
These Terms and any dispute arising out of or relating to them shall be governed by the laws of the State of Colorado, without regard to its conflicts-of-law rules. Exclusive venue and jurisdiction shall lie in the state or federal courts located in Arapahoe County, Colorado, and you consent to personal jurisdiction there.
We may suspend or terminate your access to the Website or the provision of Services at any time for any violation of these Terms or for any lawful reason. Upon termination, all rights granted to you will cease immediately, and you must discontinue use of the Website and destroy any materials obtained therefrom, except as required by law.
These Terms constitute the entire agreement between you and FixGameTech regarding the subject matter. If any provision is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall be enforced. No waiver of any term shall be deemed a further or continuing waiver. You may not assign these Terms without our prior written consent. We may assign these Terms at any time.
We strive to display accurate information, including pricing and availability, but errors, omissions, or changes may occur without notice. If you wish to request a refund or return for a product you purchased from us, the request will be evaluated in accordance with applicable federal and state consumer protection laws and our posted sales policies, if any.
